Lawyer Drags FAAN Procurement Manager, Others To Court

 

A renowned Human Rights crusader, Barrister Benjamin Barnes Arekameh, has dragged the Federal Airport Authority of Nigeria (FAAN), General Manager, Procurement Mrs. Monica Alphonse, and the Personal assistance on Procurement to the Minister of Aviation, Mr. Othman Abubakar Lawal to court for allegedly violating the Public Procurement Act.

In a court summon FHL/L/CS/586/22, made available to our correspondent on Wednesday, Barrister Arekameh alleged that the office of the Public Procurement of the FAAN in collaboration with others “are working in concert and making strenuous efforts to violate the provisions of the Public Procurement Act, 2007. By issuing an Award contract letter in desperation to some Janitorial and Cleaning services which is a gross violation of the Public Procurement Act dictate.

The Court summons reads; “A JUDICIAL PRONOUNCEMENT that the 1st, 2nd and 3rd Respondents are working in concert and making strenuous efforts to violate the provisions of Public Procurement Act, 2007, in their desperation to issue Award letters of the 1st Respondent’s Cleaning and Janitorial Service, purported contracts to the following companies namely, Scot Williams, Amah Technical and Universal Contractors Ltd, Earth Dreams Engineering & Contractors, Atlanta Cleaner Nig. Ltd, Agbofirm Consultant Ltd, Lenora Ventures, Fortune works Nig. Ltd, Cleaningful Nig. Ltd, Klean Solution Ltd and Seriyat Global Concept, without complying with the provisions of Public procurement Act, 2007, and by implication the anticipated act is invalid, illegal, null and void of no effect.”

According to the legal luminary, the office of the Public Procurement FAAN and its collaborators lack the legal footings to issue the Award contract letter, as such anticipated act is not only invalid, illegal, null, of no effect but a flagrant violation of the Public Procurement ACT 2007.

The Court summons reads further, “A JUDICIAL PRONOUNCEMENT that the 1st , 2nd and 3rd Respondents lacks the capacities to issue award Letters of the 1st Respondent as regards Cleaning and Janitorial Services, purported contracts to the following companies namely Scot Williams, Amah Technical and Universal Contractors Ltd, Earth Dreams Engineering & Contractors, Atlanta Cleaner Nig. Ltd, Agbofirm Consultant Ltd, Lenora Ventures, Fortune works Nig. Ltd, Cleaningful Nig. Ltd, Klean Solution Ltd and Seriyat Global Concept, without complying with the provisions of Public procurement Act, 2007,”
